2. Purpose and scope
This legal notice governs the use of the website gelatocontrol.com (hereinafter, “the Website”), owned by the entity identified above. Accessing the Website implies full acceptance of these terms.
The owner reserves the right to amend this legal notice at any time; changes will take effect upon publication on the Website.
3. Conditions of use
The user undertakes to use the Website and its services in accordance with the law, this legal notice and good practice, refraining from any unlawful, prohibited or harmful use affecting third-party rights or interests.
The following is expressly prohibited:
- Reproducing, distributing or modifying the content without the express authorisation of the owner.
- Using the Website to send unsolicited communications (spam).
- Introducing or spreading viruses or any malicious code in the owner’s systems.
- Attempting unauthorised access to any of the owner’s systems.
4. Intellectual and industrial property
All content on the Website —including texts, images, logos, graphics, source code, design and structure— is owned by the owner or by third parties that have authorised its use, and is protected by Spanish and international intellectual and industrial property law.
Users are only entitled to personal, private and non-commercial use of the content. Any other use requires the express written authorisation of the owner.
5. Limitation of liability
The owner does not guarantee the continuous availability of the Website or the absence of errors in its content. Under no circumstances shall the owner be liable for damages of any kind arising from the use or inability to use the Website.
The owner is not responsible for the content of websites linked from the Website, as these are outside its control.
6. GelatoControl service terms
The GelatoControl service is cloud-based software (SaaS) for the comprehensive management of gelato shops. Subscription and use of the service are governed by these terms, together with the specific plan chosen by the customer.
6.1. Document storage
All plans include, by default, up to 10 GB of storage space per account for documentation (technical datasheets, HACCP records, health certificates, payroll, contracts, invoices and other business-related files). This limit applies in aggregate across all locations and users associated with the same account.
If the customer needs additional capacity, they may request an extension free of charge by writing to hola@gelatocontrol.com, subject to reasonable, non-commercial use of the space (the service may not be used as a general file repository, external backup, hosting for audiovisual material unrelated to the business, or for any purpose other than the management of the gelato shop).
The owner reserves the right to review storage usage and ask the customer to remove files unrelated to the purpose of the service, as well as to temporarily suspend new uploads when the contracted limit is exceeded, providing prior notification by email.
6.2. AI-based document reading
GelatoControl includes an automatic reading feature powered by artificial intelligence (“AI”) that extracts data from delivery notes, labels and photographs containing batch numbers, dates or other information relevant to food traceability. Each analysis of a document or image consumes one “scan” from the monthly allowance associated with the contracted plan.
By default, plans include the following monthly AI scans: 150 scans on the 1 Scoop plan, 500 scans on the 2 Scoops plan and 2000 scans on the 3 Scoops plan. The counter resets on the first day of each billing period; unused scans do not roll over.
The customer may purchase, at any time from their dashboard, additional packs of 100 AI scans for €5 (taxes not included). These packs are consumed once the plan’s allowance is exhausted and remain valid until the end of the current billing period.
The owner makes its best effort to ensure the accuracy of the data extracted by the AI but cannot guarantee a perfect result in all cases (image quality, illegible handwriting, atypical formats, etc.). The customer is responsible for reviewing extracted data before using it for sanitary records or other legal or contractual purposes.
Processing is carried out solely for the purpose of extracting data requested by the customer. Images and documents sent to the AI service are not used to train general models and are retained as described in this privacy policy.
6.3. AI-based demand forecasting
GelatoControl includes an AI-powered demand forecasting feature that suggests to the customer which flavours to produce and in what quantity, based on the production and sales history recorded in their account and, optionally, on external variables such as the day of the week, calendar or weather.
This feature is included in the 2 Scoops and 3 Scoops plans, and is not offered on the 1 Scoop plan. For predictions to be useful, a minimum history of approximately two to three weeks of continuous activity is required; before that period the system may provide generic recommendations or no recommendation at all.
Predictions are an indicative suggestion, not a guarantee of actual demand. The owner does not guarantee the accuracy, completeness or suitability of recommendations to the customer’s particular situation. The final decision about what to produce, in what quantities and with what raw materials lies exclusively with the customer, who is solely responsible for the economic, operational, sanitary or any other consequences arising from such decisions (including waste, stock-outs or planning errors).
Processing is carried out solely to generate the predictions requested by the customer. Production and sales data are not used to train general models and are retained as described in this privacy policy.
6.4. Backups and Extended backup add-on
All plans include, at no additional cost, daily automated backups of the account data, stored in a European region different from the primary servers. The standard included retention is 7 days: backups older than 7 days are automatically deleted.
The customer may subscribe to the Extended backup add-on at €7/month (taxes not included), which provides:
- Backup retention extended to 30 days.
- On-demand restore from the customer dashboard, without needing to contact support.
- Automatic monthly integrity verification of backups.
The customer may activate or cancel the add-on at any time from their dashboard, taking effect from the next billing period. When the add-on is cancelled, backups older than 7 days will be deleted as part of the standard rotation.
Where a restore is needed due to a customer error (accidental deletion, incorrect editing, etc.), the owner will provide assistance according to the contracted plan and the availability of backups.
6.5. Availability, changes and cancellation
The customer may cancel their subscription at any time without penalty. After cancellation, data and documents will be retained for 30 days to allow export, after which they will be permanently deleted.
The owner may modify the service terms, including technical limits and the price of additional packs and add-ons, with at least 30 days’ prior email notice to the customer.
7. Applicable law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute that may arise, the parties submit to the Courts of the user’s domicile, unless the law establishes a different mandatory jurisdiction.
Privacy Policy
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data (GDPR), and Spanish Organic Law 3/2018, of 5 December, on Personal Data Protection and the guarantee of digital rights (LOPDGDD), this section sets out how personal data collected through the Website is processed.

Data is retained for as long as necessary to handle the request and, where applicable, for the duration of the contractual relationship. Once the relationship ends, data will be retained for the statutory limitation periods.
Recipients
Data is not shared with third parties, except by legal obligation or when necessary to provide the contracted service (technology service providers bound by data processing agreements in accordance with the GDPR).
Rights of the data subject
The user may exercise the following rights at any time:
- Access: to know what personal data is being processed.
- Rectification: to correct inaccurate or incomplete data.
- Erasure: to request the deletion of their data.
- Restriction of processing: to restrict how data is used.
- Portability: to receive their data in a structured format.
- Objection: to object to the processing of their data.
To exercise these rights, the user may write to hola@gelatocontrol.com, attaching a copy of their identity document. Users also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the supervisory authority in their country of residence.
